Back to school competition Terms and Conditions


1.     The Promoter

1.1.    The promoter is: Arriva Passenger Services Limited whose correspondence address for the purpose of the competition is c/o Arriva Southern Counties, Invicta House, Armstrong Road ME15 6TX.

2.     The Competition

2.1.    The title of the competition is Back to School.

3.     How to enter

3.1.    The competition will run from 17.00 on Friday 6th January (the "Opening Date") to 17.00 on Tuesday 10th January (the "Closing Date") inclusive.

3.2.    All competition entries must be uploaded to the Promoter’s Facebook pages as detailed in clause 3.3 below no later than 17.00 on the Closing Date. All competition entries received after the Closing Date are automatically disqualified.

3.3.    To enter the competition upload a photograph of a child’s school bag to one out of the three Facebook pages  detailed below;; or; or

3.4.    No purchase is necessary to enter this competition.

3.5.    Only one entry per person is allowed.

3.6.    The Promoter will not accept:

3.6.1.  responsibility for competition entries that are lost, mislaid, damaged or delayed  in transit, regardless of cause, including, for example, as a result of any, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or

3.6.2.  proof of transmission as proof of receipt of entry to the competition.

3.7.    By submitting a competition entry, you are agreeing to be bound by these terms and conditions.

3.8.    The competition entries will be judged by an independent judge and one winner will be selected based on the most “wackiest” entry.  The decision of the judge (acting reasonably) will be final.

3.9.    The Promoter will send the full name of the judge to anyone who writes within one month after the Closing Date of the competition requesting details of the judge and who encloses a self-addressed envelope to the address set out in condition 1.1

4.     Eligibility

4.1.    The competition is only open to all residents residing in Great Britain (note this does not include residents in Northern Ireland) aged 16 years or over, except:

4.1.1.  employees of the Promoter or its holding or subsidiary companies;

4.1.2.  employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the competition or its administration; or

4.1.3.  Members of the immediate families or households of (a) and (b) above.

4.2.    In entering the competition, you confirm that you are eligible to do so and eligible to claim the prize. The Promoter may require you to provide proof that you are eligible to enter the competition.

4.3.    If you are under the age of 18 years you must obtain written parental or guardian consent to enter and claim your prize. The Promoter may ask the winner to provide proof of age.

4.4.    Access to the internet and a valid Facebook account is required to enter the competition.

4.5.    The Promoter will not accept competition entries that are:

4.5.1.  automatically generated by computer;

4.5.2.  completed by third parties or in bulk;

4.5.3.  illegible, have been altered, reconstructed, forged or tampered with; or

4.5.4.  incomplete.

4.6.    The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.

5.     The prize

5.1.    There will be one winner of the competition who will receive 1 x Smiggle Voucher worth £30.00.

5.2.    The Promoter reserves the right to substitute the prize with a prize of equal or greater value and the prize is not negotiable.

5.3.    Any costs incidental to the fulfilment of the prize (other than delivery of the same in accordance with these terms) are the responsibility of the winner.

5.4.    The winner will be subject to any terms and conditions imposed by Smiggle UK Limited and/or any related third parties and it is the responsibility of the winner to familiarise themselves with any terms and conditions applicable to their prize.

6.     Winner announcement

6.1.    The winner of the competition will be announced on the Promoter’s Facebook pages detailed in clause 3.3 on 11th January 2014 (Announcement Date).

6.2.    The decision of the judge nominated by the Promoter is final and no correspondence or discussion will be entered into.

6.3.   The Promoter will also contact the winner personally on the Announcement Date by sending a private message to the winner’s Facebook account. The winner must respond to this message and provide the Promoter with a valid postal address in order to claim their prize. If the winner does not respond to the Promoter within 14 days of being notified by the Promoter then the winner’s prize will be forfeited and the Promoter will be entitled to select another winner in accordance with the process described above.

6.4.    The prize will be sent to the winner by post, please allow 14 days for delivery of the prize  

6.5.    The Promoter will send the name and county of the winner to anyone who writes within one month after the Closing Date of the competition requesting details of the winner and who encloses a self-addressed envelope to the address set out in condition 1.1.

7.     Limitation of liability

7.1.  Insofar as is permitted by law, the Promoter, its agents or distributors will not in any   circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

8.     Ownership of competition entries and intellectual property rights

8.1.    Photographs must not be the property of anyone else. By submitting a photograph, you confirm that you are the sole owner of all copyright in the photograph and that no other person has any other interest or rights in the photograph.

8.2.    Each participant must ensure that any person over the age of 18 years old who is shown in a photograph which they upload in connection with this prize draw has agreed that their image may be used in accordance with these terms and conditions. If persons under the age of 18 years old appear in a photograph uploaded by a participant, that participant must ensure that they have obtained the express permission of that child’s parents or guardians before uploading the photo. By uploading and entering a photograph into this prize draw, each participant confirms that they have obtained any necessary consents, licenses and permissions in respect of the photograph.

8.3.    Participants agree that the Promoter may use all photographs (whether the prize winner or not) without payment or royalty, and without any limitation on the duration of such use.

8.4.    All participants hereby grant to the Promoter an irrevocable, perpetual, royalty free, worldwide licence in relation to the photographs they submit. The Promoter may make such lawful use of the photographs as it decides in its sole discretion, and may, without limitation, use each photograph in any and all media (including online and in print) for publicity, promotional and news purposes.

9.     Data protection and publicity

9.1.      If you are the winner of the competition, you agree that the Promoter may use your   name, image and town or county of residence to announce the winner of this competition and for any other reasonable and related promotional purposes.

9.2.      You further agree to participate in any reasonable publicity required by the Promoter.

9.3.      By entering the competition, you agree that any personal information provided by you with the competition entry may be held and used only by the Promoter or its agents and suppliers to administer the competition.

10.  General

10.1.     If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.

10.2.     The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.
